Terms of Service

These Terms of Service ("Terms") govern access to and use of the Windflow platform — the website, dashboard, playground, APIs, and SDKs (together, the "Service") operated by Windflow ("we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

The Service provides realtime access to interactive video and world-model runtimes: you open a session, a GPU runtime is held for you, and you stream inputs and receive live frames until the session ends.

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account and API keys. Notify us promptly at founders@windflow.online if you believe your account has been compromised.

One person or organization may hold one account unless we agree otherwise in writing. We may decline registrations or limit access during the private beta.

Usage is billed in credits, prepaid usage units priced at 10,000 credits per US dollar. Credits are consumed per session-second while a session is in the ready state, at the per-model rates published on the pricing page and via the API.

• Purchased credits are refundable on request within 14 days of purchase, to the extent they remain unused.
• Promotional and signup-grant credits are non-refundable, have no cash value, and may expire.
• Credits are not transferable between accounts and are not a stored-value or deposit product.
• Session creation may reserve credits up to the session's maximum spend; unused reservations return to your balance when the session settles.

We may change published rates prospectively; rate changes never apply retroactively to completed sessions.

Use of the Service is subject to the Windflow Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of that policy are violations of these Terms.

GPU capacity is provided in scheduled windows and on available inventory. The Service is provided on an as-is and as-available basis with no uptime guarantee, no service-level commitment, and no assurance that any model or capacity will be available at any particular time. Capacity may be offline outside scheduled windows. Metering only runs while a session is ready, so unavailable capacity is never billed.

You retain ownership of the inputs you provide (prompts, uploads, camera and microphone streams) and, to the extent permitted by the license of the underlying model that generated them, the outputs returned to you. Some models are provided under third-party licenses (for example non-commercial research licenses) that may limit how outputs can be used; those license terms apply to the corresponding outputs.

You grant us the limited rights needed to operate the Service: to receive, process, transmit, and — where you use recording or upload features — store your content in order to run your sessions, deliver your streams, and maintain the platform. We do not use your content to train models.

The Service itself, including the site, APIs, SDKs, and platform software, remains our property or that of our licensors.

You may stop using the Service and request account deletion at any time. We may suspend or terminate access for violation of these Terms or the Acceptable Use Policy, for non-payment, or where required by law. On termination for violation, remaining promotional credits are forfeited; purchased credits are handled under the refund terms above except where they were obtained or used in violation of these Terms.

Model outputs are machine-generated and may be inaccurate, incomplete, or unsuitable for your purpose; you are responsible for evaluating outputs before relying on them. To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our aggregate liability arising out of or relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the claim arose and one hundred US dollars.

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and each party consents to their jurisdiction.

We may update these Terms as the Service evolves. Material changes will be announced on the site or by email, and continued use after the effective date constitutes acceptance. Contact founders@windflow.online with any questions.
